1、摘要I拒不執(zhí)行錯(cuò)誤的判決、裁定是否構(gòu)成犯罪－以刑法的價(jià)值為視角摘要拒不執(zhí)行判決、裁定罪的犯罪對(duì)象是否包括錯(cuò)誤的判決、裁定(本文所稱的錯(cuò)誤判決、裁定特指在對(duì)行為人定罪量刑時(shí)無瑕疵但后來被認(rèn)定為有瑕疵的判決、裁定)這在我國刑法理論界存在很大爭(zhēng)議：有人認(rèn)為應(yīng)當(dāng)包括錯(cuò)誤的裁判，否則司法權(quán)威和法治秩序就會(huì)面臨明顯而即刻的危險(xiǎn)；有人認(rèn)為，不應(yīng)當(dāng)包括錯(cuò)誤的裁判，因?yàn)殄e(cuò)誤的裁判從實(shí)質(zhì)上而言不具有合法性。本文共由三部分組成：第一部分，以一個(gè)案例導(dǎo)入，找出
